1. ELIGIBILITY: The Ben 10: Ultimate Alien Sweepstakes (“Sweepstakes”) is open to all legal residents of 49 of the United States (Maine is excluded) and the District of Columbia, who are at least six (6) years of age and no older than fourteen (14) years of age as of the date of entry. The following are ineligible: employees (and their immediate families (spouse, parent, child, sibling and their respective spouses) and household members (whether or not related) of The Cartoon Network, Inc. (“Cartoon Network” or “Sponsor”), Burger King Corporation (“Burger King”), Arch Marketing Solutions (“Administrator”), Time Warner Inc., and each of their respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, cable affiliates, advertising and promotion agencies and affiliated entities (collectively, the "Sweepstakes Entities").
The Sweepstakes is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Sweepstakes, participants and their parents/legal guardians agree to accept and be bound by all terms of these Official Rules and Regulations. Void in Maine, Puerto Rico, U.S. Territories and Possessions and where prohibited or restricted by law.
2. HOW TO ENTER: Participants may enter the Sweepstakes from 7:00:01 a.m. Pacific Time (“PT”) on April 5, 2010 until 11:59:59 p.m. PT on May 2, 2010 (the “Entry Period”). To enter the Sweepstakes, participants must log on to www.cartoonnetwork.com/bike, follow the directions in the interactive “drop and drag” activity to enter by creating and submitting a customized virtual bicycle and participant’s email address. Participants should get parental permission before participating.
To be eligible, entries must be submitted and received within the Entry Period. No other methods of entry will be accepted. LIMIT: one (1) entry per person, e-mail address and household per calendar day. Multiple entries received in violation of the above entry limitation, false or deceptive acts or entries, or entries generated by script, macro or other automated means or by any other means that subvert the entry process will be void, will render a participant ineligible and also may result in participant no longer being allowed to enter Cartoon Network’s sweepstakes, contests or other promotions in the future, at Cartoon Network’s sole discretion.
Entries must be submitted in the name of an eligible living individual and the prize will be awarded to the eligible living individual email account holder whose name is on or corresponds to each winning entry, provided however, a child who submits an entry in the name of his/her parent’s account will be deemed the qualifying entrant. All entries become the property of Sponsor and will not be acknowledged or returned.
The Sweepstakes Entities and their respective employees, officers, directors, representatives and agents (collectively, the “Released Parties) are not responsible for technical, hardware or software failures of any kind, lost or unavailable network, cable, satellite, Internet service provider, telephone, telephone lines or other connections, pre-emptions, blackouts or any other non-controllable acts concerning a television broadcast or incorrect, incomplete, misdirected, undelivered, lost, late, garbled or stolen entries or computer transmissions or other errors or problems of any kind which may limit or affect a person’s ability to participate in the Sweepstakes. In the event of sabotage, acts of God, terrorism, computer virus, worm, bug or other events or causes which corrupt or undermine the integrity, administration, security or proper operation of the Sweepstakes, Sponsor reserves the right to cancel, terminate, modify or suspend the Sweepstakes. In the event of termination, Sponsor reserves the right, at its sole discretion, to award the prizes from among all non-suspect eligible entries received up to the time of such action.
3. HOW TO WIN: On or around May 15, 2010, one (1) potential prize winner (when verified by the Administrator, as set forth below, the “Winner”) will be randomly selected by Administrator, an independent judging agency, from among all eligible entries received during the Entry Period. The odds of winning will depend on the total number of eligible entries received. MANY WILL ENTER, ONE (1) WILL WIN.
The potential Winner will be sent an email from the Administrator (the “Prize Notification Email”) notifying them of their status and containing a prize acceptance package; the potential Winner must submit a fully completed prize acceptance package consisting of an Affidavit of Eligibility and Liability and Publicity Release (except where prohibited by law) or a Prize Acceptance Form, and any other required documents (collectively, the “Winner Documents”), signed by a parent or legal guardian and notarized (if applicable), offline by facsimile, mail or traceable courier as outlined in the supplied instructions, to Administrator for Administrator’s receipt within five (5) days of date of the Prize Notification Email (as specified in the supplied instructions). If the potential Winner cannot be contacted or fails to sign and return the Winner Documents within the required time period, the person will be deemed ineligible, the prize will be forfeited and an alternate potential Winner will be selected by alternate random drawing from among all remaining eligible entries. Administrator will conduct up to three (3) alternate random drawings after which the prize will be deemed unawarded. The decisions of Sponsor and Administrator in all matters regarding the Sweepstakes are final and binding.
4. PRIZE: One (1) Winner will receive one (1) bicycle customized by Orange County Choppers, Inc., and a three (3) days/ two (2) nights trip to visit the Orange County Choppers facility in Newburgh, New York. Some or all of Winner’s trip will be filmed, photographed and recorded by Cartoon Network and the footage, photography and recordings will be telecast on Cartoon Network on or around October 10, 2010. The exact date and time of the telecast is to be determined by Cartoon Network in its sole discretion. The trip includes (i) two (2) round-trip, non-refundable coach class airline tickets for the Winner and his or her parent or legal guardian (“Parent”), for travel between the U.S. gateway city airport nearest the Winner’s residence to the U.S. gateway city airport nearest Newburgh, New York (if Winner resides less than 300 miles from Newburgh, New York, ground transportation from the Winner’s residence to Newburgh, NY will be provided in lieu of air transportation), (ii) ground transportation to and from the airport in New York and to and from the Orange County Choppers facility in Newburgh, New York, (iii) three (3) days/ two (2) nights double occupancy hotel accommodations for Winner and his/her Parent, and (vi) five hundred dollars ($500.00) in spending money. The approximate retail value (“ARV”) of the prize is three thousand dollars ($3,000.00). Actual value of the prize will depend on dates of travel, point of departure and any airfare fluctuations. Any difference between approximate costs and actual costs will not be refunded to the Winner. Portions of the trip, including Winner’s visit to the Orange County Choppers facility will be filmed, photographed and recorded by Sponsor.
Winner and his/her Parent are responsible for all other expenses not expressly provided for above, including without limitation, those incurred for travel to and from airports, checked baggage costs, snacks, beverages, and food, parking, incidentals, tips, telephone calls, room service, souvenirs, taxi fares, insurance, taxes or other personal expenses and hotel charges incurred during the trip. Travel arrangements must be coordinated by Administrator and are subject to change, availability and Sponsor’s approval. Blackout dates and other restrictions may apply. Sponsor reserves the right to approve any travel dates and travel must be taken between July 25, 2010 and August 8, 2010 or the prize will be forfeited and an alternate potential winner will be selected. The trip must be scheduled at least thirty (30) days in advance. Once travel is booked, no changes or cancellations will be accepted and no extensions or exceptions apply.
Winner and his/ her Parent are solely responsible for obtaining any required travel documentation and for all fees associated therewith (if any) prior to taking the trip. Winner and his/her Parent must present valid identification or current passports prior to ticketing. Winner and his/her Parent are subject to the restrictions and regulations set by airline carriers, hotels, transportation companies, and the Orange County Choppers facilities. No refunds will be made if improper documentation or failure to meet any requirement of a travel provider/supplier results in denied boarding or entry, and the trip will be forfeited. Sponsor is not responsible for any decrease in the value of the prize or the unavailability to the Winner and/or his/her Parent of all or any part of the prize resulting from the application of any such restrictions and regulations.
No substitution or transfer of prize or cash redemptions permitted by Winner. Sponsor reserve the right to substitute the prize of like value for any reason whatsoever or to transfer the Prize, at Sponsor’ sole discretion. Prize must be awarded in the name of the Winner’s Parent who must sign and return all required documents and who will be responsible for reporting and payment of any applicable federal, state and local taxes (if any). Winner’s Parent will receive an IRS 1099 Form and will be required to sign a tax acknowledgement in acceptance of the prize. The value of the prize will be stated on the acknowledgement and on any and all corresponding tax forms. Winner has the right to forfeit the prize, in which case nothing will be awarded in its place to that person and an alternate potential winner will be selected. All prize details not specified herein are at the sole discretion of Sponsor. Subject to Section 5, Winners should receive their prize(s) within six (6) to eight (8) weeks of receipt of the drawing date.
5. GENERAL RULES AND REGULATIONS: By entering this Sweepstakes and accepting the prize, Winner and his/her Parent grants the Sponsor and Sweepstakes Entities the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without compensation, notification or approval, for the purpose of advertising and publicizing the goods and services of the Sponsor and Sweepstakes Entities and all matters related to the Sweepstakes, in any manner or medium, throughout the world in perpetuity. Winner’s Parent will be required to sign, without limitation, affidavits of eligibility, liability releases, tax acknowledgment forms and, except where prohibited by law, use of name and likeness releases (“Winner Documents”) and return signed copies of the same within five (5) days of receipt of the Winner Documents. If (i) any prize, prize notification, or Winner Documents are returned as undeliverable, (ii) Winner fails to properly and/or timely reply to and/or return all required Winner Documents within the designated time, (iii) Winner declines the prize, (iv) Winner is unable to travel within the time period specified by Sponsor, or (v) Winner fails to comply with any of the Official Rules and Regulations as outlined herein, such Winner will be disqualified and an alternate potential winner may be selected by random drawing at the Sponsor’ sole discretion.
SPONSOR AND THE SWEEPSTAKES ENTITIES EXPRESSLY DISCLAIM ANY RESPONSIBILITY AND PARTICIPANTS AND THEIR PARENTS/LEGAL GUARDIANS AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS THE SPONSOR AND SWEEPSTAKES ENTITIES, AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, PARENT COMPANIES AND AGENTS, FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, DEMANDS AND/OR LIABILITY FOR INJURY, DAMAGE OR LOSS TO ANY PERSON (INCLUDING DEATH) OR PROPERTY RELATING TO OR ARISING IN CONNECTION WITH PARTICIPATION IN THIS SWEEPSTAKES (REGARDLESS OF THE CAUSE OF SUCH INJURY OR LOSS), THE DELIVERY AND/OR SUBSEQUENT USE OR MISUSE OF ANY PRIZE AWARDED, OR PORTION THEREOF, AND/OR PRINTING, DISTRIBUTION OR PRODUCTION ERRORS. PARTICIPANTS AND THEIR PARENTS/LEGAL GUARDIANS ACKNOWLEDGE THAT PRIZES ARE AWARDED “AS IS” AND THAT SPONSOR AND SWEEPSTAKES ENTITIES HAVE NOT MADE, AND ARE NOT IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY REPRESENTATION, GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, IN LAW OR IN FACT, RELATIVE TO THE PRIZES OR ANY PORTION THEREOF, INCLUDING, BUT NOT LIMITED TO ITS QUALITY, ACCESSIBILITY, MECHANICAL CONDITION OR FITNESS FOR A PARTICULAR PURPOSE.
6. DISPUTES: Except where prohibited, participants agree that any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or the prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Fulton County, Georgia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and Regulations or participants’ and/or Sponsor’s rights and obligations in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.
